1. Agreement to Terms

By accessing or using the services provided by Avighna Innovative Solutions ("Avighna", "we", "us", or "our"), including our website, structural estimating, Building Information Modeling (BIM) detailing, and connection design engineering, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Scope of Services

Avighna Innovative Solutions provides specialized structural engineering services strictly for the commercial, industrial, and civic construction sectors. Deliverables may include, but are not limited to, 3D structural models (LOD 400), fabrication shop drawings, NC1 files, material take-offs, and signed connection design calculations. The specific scope, timeline, and deliverables for any engagement will be outlined in a mutually executed Project Proposal or Statement of Work (SOW).

3. Client Responsibilities & Inputs

To ensure the accuracy and timely delivery of our services, clients are responsible for providing complete, accurate, and up-to-date architectural, structural, and mechanical/electrical/plumbing (MEP) design documents.

  • Avighna is not liable for errors, delays, or clashes resulting from outdated, conflicting, or incomplete blueprints provided by the client.
  • Any revisions to the base architectural or structural designs made after the commencement of drafting or estimating may incur additional variations or change orders.

4. Intellectual Property Rights

Upon receipt of full payment for the agreed-upon services, the specific deliverables (e.g., PDF drawings, NC1 files, specific federated BIM models) generated for the project shall become the property of the client. However, Avighna Innovative Solutions retains all rights to its proprietary detailing methodologies, standard operational procedures, macros, custom software scripts, and internal workflow systems used to generate said deliverables.

5. Accuracy and Limitation of Liability

While we utilize rigorous internal quality assurance protocols and automated clash detection to ensure the highest level of accuracy:

  • It remains the ultimate responsibility of the fabricator or the primary Engineer of Record (EOR) to review and approve all shop drawings and connection calculations prior to fabrication or erection.
  • Unless explicitly contracted to act as the Engineer of Record for a specific jurisdiction, Avighna Innovative Solutions serves as a detailing and consulting partner.
  • In no event shall Avighna Innovative Solutions be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, arising from fabrication errors, site delays, or the use of our deliverables.

6. Confidentiality

We understand the sensitive nature of B2B construction projects. Avighna Innovative Solutions agrees to hold all client-provided blueprints, proprietary designs, and financial project data in strict confidence. We will not disclose this information to unauthorized third parties without prior written consent, except as required to execute the contracted services or by law.
